Use of Member Information - Privacy Statement
SIMMONS APPRAISING DOES NOT DISCLOSE CLIENT CONFIDENTIAL INFORMATION WITHOUT THE EXPRESSED WRITTEN PERMISSION FROM THE CLIENT(S), OR AS PRESCRIBED BY PRIOR AGREEMENT OR LAW. CLIENT CONFIDENTIAL INFORMATION EVEN INCLUDES THE FACT THAT AN ASSIGNMENT, APPRAISAL, AND/OR APPRAISAL REPORT EVEN EXIST(ED). SIMMONS APPRAISING CAN AND WILL NOT DISCUSS ASSIGNMENTS OR ASSIGNMENT RESULTS WITH ANYONE BUT THE DEFINED BY USPAP AND AGREED TO CLIENT. "PAYING FOR AN APPRAISAL SERVICE" DOES NOT MAKE SOMEONE THE CLIENT OF SIMMONS APPRAISING UNLESS AGREED TO IN WRITING BY SIMMONS APPRAISING.
At Simmons Appraising our client service
is very important to us. As we continue to improve and expand our services and
delivery channels, we recognize our clients' needs and desires to preserve their
privacy and confidentiality. (Federal and State regulations and laws
specifically define who is the appraiser's client in certain situations. Do not
assume you are the appraiser's client without such in writing and signed from
Simmons Appraising.)
Safeguarding our clients' privacy is also very important to us. We, at Simmons
Appraising, have adopted standards that help to maintain and preserve the
confidentiality of clients' nonpublic information.
The following Statement affirms our continued efforts to safeguard client
information.
Information we collect
We gather nonpublic personal information about our client and their customers as may be necessary
to conduct business with our clients. CUSTOMERS OF OUR CLIENTS ARE NOT
RECOGNIZED AS CLIENTS UNLESS AGREED TO IN WRITING.
We collect nonpublic personal information about clients and their customers from the following
sources:
Information we receive from clients on applications or other forms, over the
telephone or in face-to-face meetings, and via the Internet. Examples of
information we receive from clients and their customers include name, address,
telephone number, etc.
Information we received form our clients' customers about transactions with us or others. Examples of information relating to transactions include contracts, history, and financial information et al. CUSTOMERS OF OUR CLIENTS ARE NOT RECOGNIZED AS CLIENTS UNLESS AGREED TO IN WRITING.
Information we receive from a agents of our clients or their customers or their agents. Examples of information from clients include name, address, phone number, employment, financial information, plans & specifications, contracts etc. From individual agents, builders and others to verify information you have given to us. Examples of information provided by agents, builders or others include name, address, phone number, payments, financial information, etc.
Information we disclose
We do not disclose any nonpublic information about our clients or
former clients to anyone, except as permitted by law and except as described in
the next paragraph.
We may disclose all of the information we collect, as described above, to our clients and their assigns or as directed by law. Information may also
be used by affiliated appraisers unless such is specifically limited by our client.
Information may be disclosed as directed to others upon written permission of
our client if also agreed to by Simmons Appraising and involved individual
appraisers.
Simmons Appraising reserves the right to not disclose any information even if
written permission from the client has been given.
Protecting clients' information
Simmons Appraising maintains physical, electronic, and procedural safeguards
that comply with federal regulations to guard your nonpublic personal
information.
Effective date
This Privacy Statement is effective as of November 13, 2003, and applies to
products or services provided by Simmons Appraising. We reserve the right to amend (that is,
add to, delete or change) the terms of this Privacy Statement from time to time.
